The following will, and supporting documentation, of William H. Barringer of the Town of Tompkins. --Doug Boyer, October 22, 2001

Record of the Last Will and Testament of William Barringer, Deceased


Be it remembered, That heretofore, to wit: on the 28th day of June, in the year of our Lord one thousand nine hundred and fifteen, Annetta Barringer and Alvin Barringer, the Executors named in the Last Will and Testament of William H. Barringer, late of the Town of Tompkins in the County of Delaware, deceased, appeared in open Court, before the Surrogate of the County of Delaware, and made application to have the said Last Will and testament which relates to both Real and Personal Estate, proved, and on such application the said Surrogate did ascertain by satisfactory evidence who were the heirs at law and next of kin of the said testator and their respective residences, and said Surrogate did thereupon issue a Citation in due form of law, directed to the heirs at law and next of kin by their respective names, requiring them to appear before said Surrogate at his office in the Village of Delhi in said County, on the 2d day of August, A. D. 1915, to attend the probate of said Will.


And afterwards, to wit: on the 2d day of August, A. D. 1915, satisfactory evidence by affidavit was produced and presented to said Surrogate, of the due service of said Citation in the mode prescribed by law, and on that day the proponent having appeared in support of the probate of said Will, and no one appearing to oppose the probate of the same such proceedings were thereupon had in said Court that the said Surrogate took the proofs of said Will hereinafter set forth, upon this 2d day of August A. D. 1915, and he thereupon adjudged the said Will to be a valid Will of Real and Personal Estate, and the proofs thereof to be sufficient, which said Last Will and Testament and proofs, are as follows, that is to say:


Last Will and Testament


I, William H. Barringer of the Town of Tompkins in the County of Delaware, and State of New York, being of sound mind and memory, do make, publish and declare this my last Will and Testament in manner following, that is to say:


First - I direct that all my just debts and funeral expenses be paid.


Second - I give, devise and bequeath unto my beloved wife Annetta Barringer the use during the term of her natural life of all the real and personal property of whatever kind, name or description of which I may die seized or possessed together with the right and power upon the part of my said wife to use as much of the principal or corpus of my said real & personal property, as she may desire or deem best for the use care or support of herself or any of our children and her judgement in the matter shall be conclusive and binding upon all my heirs or next of kin or any person interested in my estate & cannot be questioned by them or either of them and to fully carry out the provisions of my said Will thereby authorize my Executors hereinafter to sell any & all real estate of which I may die seized, if necessary & give all necessary & proper deals therefor.


Upon the death of my said wife Annetta Barringer or in case she should not survive me then at my decease, I give whatever may remain which has not been used up of my said real & personal property or the proceeds thereof to my two sons Adelbert Barringer and Alvin Barringer in trust nevertheless for the support maintenance and care of my invalid sons George Henry Barringer and Robert Barringer, during their & each of their natural lives together with the power in said trustees to use as much of the principal or corpus of my estate that is left after my wifes death for the care and maintenance of my two invalid sons as may be necassary upon the death of my two invalid sons, the I give & devise whatever if any may remain of my said real & personal property unto such of my children as may be living at such time.


Lastly, I hereby appoint my said wife Annetta Barringer & my son Alvin Barringer executors of this, my last Will and Testament hereby revoking all former wills by me made & I especially provide that neither my Executors or the Trustees herein named shall be compelled to give any Bonds whatever.

We, whose names are hereunto subscribed, Do certify that on the 23rd day of September 1914 William H. Barringer of Tompkins, NY the testator subscribed his name to this instrument in our presence and in the presnece of each of us, and at the same time, in our presence and hearing declared the same to be his last Will and testament and requested us, and each of us, to sign our names thereto as witnessesto the execution thereof, which we hereby do in the presence of the testator and of each other, on the said date, and write opposite our names our respective places of residence.

Samuel H. Fancher of the town of Walton, NY in the County of Delaware, being duly sworn as a witness in the above entitled matter, and examined in open Court in behalf of the proponent to prove said Will, depses and says:


I was well acquainted with William H. Barringer the said testator, and had known him for more than 5 years before his death. The subscription of the decendent's name to the instrument now shown to me, and offered for probate as his last Will and Testament, and bearing date the 23rd day of September, in the year of our Lord one thousand nine hundred and fourteen, was made by the decedent at his home in the Town of Tompkins in the County of Delaware, in the presence of myself and Thomas Phoenix, the other subscribing witness. At the time of such subscription the said decedent declared the said instrument, so subscribed by him to be his last Will and testament; and I thereupon signed my name as a witness, at the end of the said instrument, at the request of said decedent, and in his presence, and in the presence of said Thomas Phoenix. I also saw said Thomas Phoenix, the other subscribing witness, sign his name as a witness at the end of said Will, and know that he did so at the request of said decedent and in his presence. the said decedent, at the time of so executing said instrument, was upwards of the age of twenty-one years, and of sound mind, memory and understanding, and not under any restraint, or in any respect incompetent to devise real estate.

Thomas Phoenix of the town of Tompkins, NY in the County of Delaware, being duly sworn as a witness in the above entitled matter, and examined in open Court in behalf of the proponent to prove said Will, depses and says:

In the Matter of Proving the Last Will and Testament

Satisfactory proof having been made of the due service of the Citation heretofore issued in this matter, requiring the proper persons to appear in this Court on the 2d day of August, 1915 and attend the probate of the Last Will and Testament of William H Barringer, late of the Town of Tompkins, County of delaware, deceased, bearing date the 23d day of September, 1914; and Annetta Barringer and Alvin Barringer, the Executors named in the Will, having appeared in person and by Fancher & Fancher, their attorneys, in support of the probate of the same, and A. G. patterson, esq., having been appointed and appeared as special Guardian for Willimia Sherman, Antoinette Sherman, Maria Sherman and terry Sherman, infants and no other parties or persons having appeared, and the several witnesses having been examined before the Surrogate and the proofs reduced to writing, and the said Surrogate having inquired particularly into all the facts and circumstances, and it appearing that the Will was duly executed, that the testator at the time of executing it was in all respects competent to make a Will and not under restraint; and the said Surrogate being satisfied of the genuineness of the Will and the validity of its execution, the probate not being contested:


It is ORDERED, ADJUDGED AND DECREED, that the said instrument is the Last Will and Testament of the said William H. Barringer, deceased; that the same be and hereby is admitted to probate as a Will valid to pass real and personal property, and that Letters Testamentary issue to Sherman Van Valkenburgh, the Executor named herein, upon his taking the oath prescribed by law.

That the above named decedent died at the town of Tompkins County of delaware N.Y., on the 13th day of February 1915, that said decedent left a Last Will and Testament which is duly executed according to the Laws of the State of new York, and in which Alvin Barringer of Walton N.Y. and Annetta Barringer of Tompkins N.Y. were named as executors.


That this deponent has made a careful estimate of the value of the estate of decedent; that the estimated value of decedent's estate is as follows:
Real Estate one farm Tompkins, N.Y. $2500.
Personal Property money on hand...... $425.
Total....................................................... $2925.


That the said estimate is made by deponent on the basis of the market value of said estate at the time of decedent's death; that deponent has stated in Schedule A, hereto annexed, the facts required to be stated by the law known as the Transfer Act; that such statement is true to the best of the knowledge, information and belief of this deponent.

Barringer, dated and executed September 23rd 1914 by the terms of which the real and personal property of said William H. Barringer is devised and bequeathed to my mother during her life time with the right to use as much as she may deem necessary and proper for the support of herself and children and at her death the portion remaining is left in trust for the benefit of two invalid sons of said William H. Barringer and at their death whatever remains is to be divided among the then surviving children of said William H. Barringer.

Barringer, the sum of $200., being in lieu of any right or distributive share from our father's estate, except whatever sum maybe receibed by us or either of us by virtue of a will of said William H. Barringer, dated and executed September 23rd 1914, by the terms of which the real and personal property of said William H. Barringer is devised and bequeathed to our mother during life with the right to use such amount as she deems proper for the support of herself or family, and at her death the remaining portion is left in trust for the benefit of two invalid sons of said William H. Barringer, and at their death whatever remains is to be divided among the then surviving children of said William H. Barringer.

I, Edith Carson of Lac du Flambeau, Wisconsin being the daughter of William H. Barringer of Tompkins, N. Y. do hereby certify that I have received from my said father the sum of $200. in lieu of any right or distributive share in my father's estate except whatever sum may hereafter be received by me by virtue of a will of said William H. Barringer, dated and executed September 23rd 1914 by the terms of which the real and personal property of said William H. Barringer is devised and bequeathed to my mother during her life time with the right to use as much as she may deem necessary and proper for the support of herself and children and at her death the portion remaining is left in trust for the benefit of two invalid sons of said William H. Upon the petition of Annetta Barringer and Alvin Barringer, proponents, you are hereby cited to show cause before the Surrogate's Court of Delaware County at the Surrogate's Office in the Village of Delhi, in said County, on the 2d day of August, 1915, at 10 o'clock in the forenoon, why a decree should not be granted admitting to probate a certain instrument in writing as the Last Will and Testament of William H. Barringer, late of the Town of Tompkins, said County, deceased, as a valid Will of Real and Personal property; and also to show cause why Letters Testamentary should not issue thereon.

Whereas a proceeding has been commenced in the Surrogate's Court of the County of Delaware, for the probate of the last will & testament of William H. Barringer, deceased late of the town of Tompkins, N.Y., in said County, deceased, and Willimia Sherman, Antoinette Sherman, Wavia Sherman, Henry Sherman has been duly cited to appear therein:


And whereas, said parties infants, and have not appeared in said proceeding by a General Guardian;


Now therefore, know ye, That in pursuance of an order in said proceeding duly entered, and of the Statute in such case made and provided, you are hereby appointed the Special Guardian for the said infants, for the sole purpose of appearing for them and taking care of this interest in said proceeding.

Barringer, deceased and hereby consent to serve as such Special Guardian, and certify that I have no interests adverse to that of the said infants, and am in no way connected in business with the attorney or counsel of the adverse party.

The petition of Annetta Barringer & Alvin Barringer of Tompkins & Walton, in the County of Delaware and State of New York, respectfully shows:


That William Barringer late of the Town of Tompkins in the County of Delaware, aforesaid, died on the 13th day of February in the year of our Lord, one thousand nine hundred and fifteen.


The said deceased was at the time of his death a resident of the town of Tompkins in the County of Delaware:


Said deceased left a last will and testament, which is dated the 23rd day of September in year of our Lord, one thousand nine hundred and fourteen. Your petitioners are the executors named in said will. The said deceased left Annetta Barringer his widow, residing at Tompkins State of New York. The following named persons are the only heirs-at-law and next of kin of said deceased, and their degree of relationship to the said deceased, their places of residence and postoffice addresses are respectfully as follows, viz.:

That the following is a statement of the facts showing what effort has been made to ascertain the names and post office addresses of the persons whose names and post office addresses are stated as unknown: these facts are all within the personal knowledge of the petitioners.


That there are no other persons than those mentioned ineterested in the application or proceeding.


That all the above-named persons are of full age and sound mind, except the following are infants of the ages respectfully as follows, viz.: Willimia Sherman over 18 years of age, Antoinette Sherman over 16 years of age, Waivey Sherman 12 years of age, Henry Sherman 8 years of age all of whom reside with their father Seymour Sherman at Tompkins Delaware Co NY


That the will realtes to both real and personal estate, and as your petitioners are informed and believe, the value of the personal property does not exceed $500, and that said deceased left real estate not exceeding in value the sum of $2000.


That no previous petition for the probate of said will, or for a grant of letters testamentary, or of administration of the personal property of the decendent, has been filed or presented in any court to the knowledge or belief of your petitioner.


Wherefore your petitioner prays that siad last will and testament may be proved, that the same may be recorded and letters testamentary be granted thereon in pursuance of the statute in such cases made and provided; that said widow, heirs-at-law, next of kin and other necessary parties be cited to show cause why said last will and testament should not be admitted to probate.


And your petitioner further prays for an order directing service of a citation herein without the State of New York or by publication upon the persons and corporations named herein as non-residents, or who, or whose residence, are unknown, and upon the persons and corporations named herein as residents who it is shown can not be served within the State of New York.
