The Will of Paulina Law

Be it Remembered, That at a Surrogate's Court, held at the Surrogate's Office in Delhi in and for the County of Delaware, on the 1 day of Dec 1890, the last Will and Testament of Paulina Law late of the Town of Colchester in the County of Delaware, deceased, was duly proved, before Albert H. Sewell, Esq., Surrogate of said County, and was by said Surrogate adjudged valid, and established as a Will of real and personal Estate, and the sa.. together with the proofs and examinations taken on the probate thereof, are, pursuant to an order of the Surrogate here recorded, to w..

In the name of God. Amen. I Paulina Law of the age of seventy nine years being of sound mind and memory do hereby make publish and declare this my last Will and Testament in name favoring viz
First, I give and bequeath to my daughter Mary Adeline Holmes Eight hundred dollars ($800.)
Secondly, I give and bequeath to my son William S. Law the sum of One thousand dollars ($1000.)
Thirdly, I give and bequeath to my daughter Sarah Eliza Young the sum of Eight hundred dollars ($800.)
Fourthly, I give and bequeath to the Babtist Society of Walton one hundred dollars $100
If any thing remains of my Estate after paying my debts funeral expenses, the settling up of any estate... I do hereby will that it shall be paid to my son Wm. S. Law & if there shall not be enough to pay the above amounts or legacies then each shall be paid in proportion to the amounts willed. I do hereby revoke all other wills by me made &
Lastly, I hereby nominate and appoint Alston W. Hulbert Executor of this my last Will and Testament.
In Witness Whereof I have hereunto set my hand and seal this 17th day of September 1888.

NOTES: There are parts of the document that did not copy and I could not read. The misspellings are in the original document. Born Paulina Holmes Sept. 9, 1809 in New York and died Sept. 20, 1890. Widow of Samuel A. Law (Aug. 17, 1808 - May 3, 1888). Both are buried at Back River Road Cemetery, Walton, NY (great-great-great-grandparents). Mary Adeline Holmes (Dec.18, 1830, Greene Co, NY - 1916, Cass Co, NE) is the wife of John B. Holmes (1831 - 1898, Cass Co, NE). There is a write up on John B. Holmes at the Cass Co., NE GenWeb site - "Biographical Album of Otoe & Cass Counties" which discusses his Delaware County ancestry. William Sanford Law (Feb. 2, 1835, Greene Co, NY - Apr. 14, 1911) is the husband of Almeda Mary Fuller (Bet. 1834-41 - Apr. 28, 1907) (great-great-grandparents). Sara Eliza Young (Feb. 10, 1848, NY - 1933, Cass Co, NE) is the wife of Francis Marion Young (Feb. 1841, MO - 1912, Cass Co, NE).


PETITION FOR LETTERS OF ADMINISTRATION
In the Matter of the Estate of
Samuel A. Law deceased.

To the Surrogate's Court of the County of Delaware, in the State of New York:

THE PETITION OF William S. Law of town of Colchester in the County of Delaware, and State of New York, respectfully shows: That Samuel A. Law a resident of the town of Hamden, County of Delaware, State of New York, died on the 3rd day of May, 1888, at the town of Hamden in the County of Delaware, State of New York, without leaving any last will and testament, to the best of your petitioner's knowledge, information and belief.
That the said decedent died possessed of certain personal property within this State and County, and that your petitioner is informed and believes, the value of the personal property which the said decedent died possessed [together with the probable amount to be recovered, by reason of any right or action granted an administrator of the said decedent, by special provision of law], does not exceed the sum of Fifteen hundred dollars.
That the said decedent left him surviving Perlina Law, his widow, who resides at the town of Hamden in the State of New York; and the following named persons are all the next of kin of the said decedent, and their respective ages and places of residence, as far as they are known to your petitioner, or can be ascertained by him with due diligence, to wit:

Perlina Peak a daughter 32 years of age, residing at Hamden State of New York
Adaline Holmes a daughter 58 years of age, residing at Rock Bluff Cusk Co State of Nebraska
Calfurnia Furlong a daughter 51 years of age, residing at Rock Bluff Cusk Co State of Nebraska
Eliza Young a daughter 40 years of age, residing at Rock Bluff Cusk Co State of Nebraska
Thomas Law a Grandson under 14 years of age, residing at Walton State of New York
John Law a Grandson under 14 years of age residing at Rock Bluff State of Nebraska
Sherry Peak a Grandson about 20 years of age, residing at Walton, State of N.Y.
Frank Peak a Grandson over 14 years of age, residing at Walton State of NY.
Arthur Peak a Grandson about 14 years of age residing at Walton N.Y.
Hurbut Peak a Grandson about 12 years of age residing at Walton N.Y.
Lilian Peak a Grand daughter about 10 years of age residing at Walton N.Y.
That you petitioner is a son of the said decedent.
That no petition for a grant of letters of administration upon the said estate has been filed in any Surrogate's Court of this State, as your petitioner is informed and believes.
Your petitioner therefore prays for a decree awarding letters of administration upon the goods, chattels and credits of the said deceased to Alston W. Hulbert of the Village of Downsville & your petitioner being the oldest child of the deceased hereby renounces all claim that he has is the administration of said estate and that a citation may be issued to all persons having a right to administration, prior or equal to that of your petitioner, to show cause why such decree should not be made.

Calphurnia Furlong (Dec. 6, 1837, NY - 1910, Cass Co., NE) is the wife of Samuel L. Furlong (Oct. 1839, MI - 1923, Cass Co., NE).
Sara Eliza Young (Feb. 10, 1848, NY - 1933, Cass Co, NE) is the wife of Francis Marion Young (Feb. 1841, MO - 1912, Cass Co, NE).
Thomas Law (abt. 1878) is the youngest son of James A. Law (Apr. 13, 1852 - May 17, 1880) and Adeline Tompkins (abt. 1844 - Mar. 7, 1879).
John Law (abt. 1876) is a son of James A. Law and Adeline Tompkins. After the death of their parents, Thomas and his eldest sister Mary Adeline Law (abt. 1875) lived with their grandparents, Thomas and Sarah Tompkins in Walton and John lived with Samuel Law's family in Hamden. At some point, John must have been sent to live with one of his aunts in NE.
Sheridan Peake (Sept. 13, 1867, Hamden, NY - Oct. 14, 1946, Utica, NY) is the eldest child of Ira R. Peake and his 2nd wife, Abigail Law (Jan. 29, 1840 - Sept. 27, 1875). Francis Peake (Jul. 26, 1869 - Oct. 26, 1946, Jamestown, Stutsman Co., ND) is the second child of Ira R. Peake & Abigail Law.
Arthur Peake (Aug. 14, 1871 - Feb. 12, 1942, Valley City, Barnes Co., ND) is the third child of Ira R. Peake and Abigail Law.
Herbert Peake (Aug. 15, 1873 - abt. 1963, Summit, Union Co., NJ) is the fourth child of Ira R. Peake and Abigail Law.
Lillian A. Peake (Apr. 18, 1875 - 1958, Oneonta, Otsego Co., NY) is the youngest child of Ira R. Peake and Abigail Law.
