WILL OF

Maynard, Edward B. - Harpersfield E-202
Delaware Co., NY
Probated 3 February 1852

In the name of God Amen: I Edward B. Maynard of the town of Harpersfield in the County of Delaware and State of New York, of the age of twenty-two and being of sound mind and memory do make, publish and declare this my last Will and Testament in manner following, that is to say,

First: I give and bequeath unto my wife Sabrina C. Maynard one equal undivided half of all my personal property to be accepted and received by her in lieu of Dower and to my daughter Sarah Elizabeth, the other half of all my personal property.

Second: I will that the property of my daughter Sarah Elizabeth be safely loaned out, and that the interest thereof be given to my wife Sabrina C. until my daughter shall arrive at the age of eighteen years.

Third: I appoint my uncle Samuel B. Maynard my executor, and my wife Sabrina C. Maynard executrix of this my last Will and Testament, hereby revoking all former wills by me made.

In witness whereof I have hereunto set my hand and seal the twenty-ninth day of October in the year of our Lord one thousand eight hundred and fifty one.

The above instrument consisting of one sheet was as the date thereof signed, sealed, published and declared by the said Edward B. Maynard as and for his last Will and Testament in presence of us, who at his request and in his presence and in the presence of each other have subscribed our names as Witnesses thereof.

In the matter of the Probate of the last Will and Testament of Edward B. Maynard late of said County deceased as a Will of Personal Estate.
Delaware County SS

Stoddard Stevens, of the town of Harpersfield in the County of Delaware being sworn deposes that he saw the above named Edward B. Maynard late of the town of Harpersfield in the County of Delaware deceased subscribe and execute to the instrument now shown him and which purports to be the last Will and Testament of the said Edward B. Maynard and bears the 29th day of October 1851, and that he heard the said Edward B. Maynard declare the said to be his last Will and Testament and that he this deponent together with Calvin C. Covil the other subscribing witness subscribed his name as a witness to said Instrument at his request, and at the time thereof the said Edward B. Maynard was of sound mind and memory, of full age to make said Will and not under any restraint.

Calvin C. Covil of the town of Harpersfield in the County of Delaware being sworn deposes that he saw the above named Edward B. Maynard late of the town of Harpersfield in the County of Delaware deceased subscribe and execute the Instrument now shown him and which purports to be the last Will and Testament of the said Edward B. Maynard and bears date the 29th of October 1851, and that he heard the said Edward B. Maynard declare the same to be his last Will and Testament, and that he this deponent together with the other subscribing witness subscribed his name as a witness to said Instrument at his request, and at the time thereof the said Edward B. Maynard was of sound mind and memory, of full age to make said Will and not under any restraint.

Be it remembered that at a Surrogates Court held at the Office of the Surrogate in Delhi in the County of Delaware and the State of New York the last Will and Testament of Edward B. Maynard late of the town of Harpersfield in said County was duly proved before William Gleason Jun. County Judge acting as Surrogate of said County according to law and was by him allowed and established as and for the last Will and Testament of the Personal Estate of the said Edward B. Maynard, and in pursuance of (an order of) and acting Surrogate the said last Will together with the Proof taken thereof are herein recorded.

And I do certify that the foregoing is a correct record of the whole of the Will of Edward B. Maynard late of the town of Harpersfield in said County of Delaware and also of the proofs of the same and that the same were Recorded this 3rd day of February 1852.
