LAST WILL AND TESTAMENT OF COLEY MAYNARD

Be it remembered that at a Surrogates Court held at Delhi in and for the County of Delaware on the 30th day of June 1857, the last Will and Testament of Coley Maynard late of the town of Stamford in the County of Delaware deceased was duly proved before J. Palmer Surrogate and was thereupon adjudged by said Surrogate proved valid and established as a will of Real and personal estate and the same together with the proofs taken thereon are here recorded pursuant to an order of said Surrogate, to wit:

In the name of God amen, I Coley Maynard of the town of Harpersfield, in the County of Delaware and State of New York being of sound mind and memory do make, declare and publish this my last Will and Testament.

First: I give and bequeath to the children of my oldest daughter Sally Potter deceased, the sum of five hundred dollars to be divided equally among her said children.

Second: I give and bequeath to my grandchild Elizabeth Maynard (daughter of my son Edward, deceased) the sum of two hundred and twenty four dollars if she shall attain the age of twenty one years, but if she does not live to the said age of twenty one years, then the said sum shall be equally divided among my six children or their heirs, Stephen, Andrew, Harry, Rebecca Peters, Jane Vandyke, and Diantha Powell, and if either of them shall die without children, then to the survivor or survivors of my children in this clause mentioned.

Third: I also give, devise and bequeath to my beloved wife Elenor all the rest and residue of my Real and personal estate as long as she shall remain unmarried and my widow, but on her decease or marriage the remainder thereof I give and devise to my six children Stephen, Andrew, Harry, Rebecca Peters, Jane Vandyke and Diantha Powell, and their heirs respectively to be divided in equal shares between them.

I do nominate and appoint my beloved wife Elenor to be Executrix and my son Stephen Maynard Executor of this my last Will and Testament.

In testimony whereof, I hereunto set my hand and seal and publish and devise this to be my last Will and Testament in the presence of the witnesses named below this twenty eighth day of July in the year of our Lord one thousand eight hundred and fifty two.

In the Matter of the Probate of the last Will and Testament of Coley Maynard late of said County deceased, as a Will of Real and personal estate.

Delaware County, SS

C.R.N. Champlin of the town of Stamford in the County of Delaware being sworn deposes that he saw the above named Coley Maynard, late of the town of Stamford in the County of Delaware deceased, subscribe and execute the instrument now shown him and which purports to be the last Will and Testament of the said Coley Maynard and bears date the 28th day of July 1852 and that he heard the said Coley Maynard declare the same to be his last Will and Testament and that he this deponent together with Sylvester W. Maynard the other subscribing witness subscribed his name as a witness to said instrument at his request and at the time thereof the said Coley Maynard was of sound mind and memory, of full age to make said Will and not under any restraint.

Maynard of the town of Bainbridge in the County of Chenango being sworn deposes that he saw the above named Coley Maynard late of the town of Stamford in the County of Delaware deceased, acknowledge and execute the instrument now shown him and which purports to be the last Will and Testament of the said Coley Maynard and bears date the 28th day of July 1852 and that he heard the said Coley Maynard declare the same to be his last Will and Testament and that he this deponent together with C.R.N. Champlin the other subscribing witness, subscribed his name as a witness to said instrument at his request and at the time thereof the said Coley Maynard was of sound mind and memory, of full age to make said Will and not under any restraint.
