David C. Scotts Will

Be it remembered that at a Surrogates Court held at the Surrogates office in Delhi on the 15th day of March 1851 The last Will & Testament of David Scott late of Harpersfield in Delaware County deceased was duly juried before the Surrogate according to law & was adopted by the Surrogate to be a valid will of real & personal estate:

Which said Will & the proofs are as follows:

The last Will & Testament of David C. Scott of Harpersfield in the County of Delaware & State of New York considering the uncertainty of this mortal life and being of sound mind & memory blessed be God for the same I do make & publish this my last Will & Testament as follows

First My funeral expenses to be paid from my estate before any division of the same.

Second All my just debts are to be paid.

Third I give an bequeath to my mother Jane Scott the sum of five dollars.

Fourth I give & bequeath to my sister Jane G. Campbell the sum of five dollars.

Fifth I give & bequeath to my brothers John G. Scott, William Scott, Thomas Scott, James Scott, Henry R. Scott, Joseph Scott & Samuel H. Scott each the sum of five dollars.

Sixth I give & devise all my real estate of every name & nature whatsoever to my dear wife Elisabeth W. Scott to be hers in fee and at her disposal for ever.

Seventh I give & bequeath to my said wife Elisabeth W. Scott all the rest render & remainder of my personal estate goods & chattels of what nature or hereto recover to be hers in the own right forever.

I hereby nominate constitute & appoint my said wife Elisabeth W. Scott executrix & my brother in law James C. Young executor of this my last Will & Testament hereby revoking all former wills by me (illegible).

In witness whereof I have henceto set my hand & seal the nineteenth day of November in the year of our Lord one thousand and eight hundred & fifty.

The above named instrument consisting of one sheet was at the date thereof signed sealed published & declared by the said David C. Scott as & for his last Will & Testament in presence of us who at his request & in his presence & in the presence of each other have subscribed our names as witnesses thereto.

said County deceased as a will of

Delaware County

Harlo Haker of the town of Harpersfield in the County of Delaware being sworn deposes that I saw the above named David C. Scott late of the town of Harpersfield in the County of Delaware deceased subscribe & execute the instrument now shown him & which purports to be the last Will & Testament of the said David Scott & bears date the 19th day of November 1850 & that he heard the said David C. Scott declare the same to be his last Will & Testament & that he this disponent together with Phineas Doan the other subscribing Witness subscribed his name as a witness to said instrument at his request & at the time thereof the said David C. Scott was of sound mind & memory of full age to make said Will & not under any restraint.

(same matter) Delaware County Phineas Doan being sworn disposes that he saw the above named David C. Scott late of the town of Harpersfield in the County of Delaware deceased subscribe & execute the instrument now shown him & which purports to be the last Will & Testament of the said David Scott & bears date the 19th day of November 1850 & that he heard the said David C. Scott declare the same to be his last Will & Testament & that he this despondent together with Harlo Haker the other subscribing witness subscribed his name as a witness to said instrument at his request & at the time thereof the said David C. Scott was of sound mind & memory of full age to make said Will & not under any restrain.
