Donald Crawford's Will.

Be it remembered that at a Surrogate's Court held at the Surrogate's Office in the Village of Delhi, in and for the County of Delaware on the 15th day of September 1869 the last will and Testament of Donald Crawford, late of the town of Hamden in the County of Delaware deceased was duly proved before Edwin D. Wagner Surrogate of said County and was by said Surrogate adjudged valid and established as a Will of Real and Personal Estate and the same together with the proofs and examinations taken on the probate thereof are pursuant to an order of said Surrogate here recorded to wit.
In the name of God Amen.
I, Donald Crawford, of the town of Hamden, County of Delaware and State of New York, of the age of Eighty years and being of sound mind and memory do make publish and declare this my last Will & Testament in the manner following that is to say-

First:

I give bequeath and devise unto my wife Louisa Crawford all that certain piece or parcel of land lying on the North side of the highway leading from the Village of Hamden to Hamden Hill and bounded on the North by the lands George Brainard, on the South by the Village lot of the Widow Micholem on the South by the highway leading to Hamden Hill & on the West by the same highway said land being in or near the Village of Hamden, in the County of Delaware & State of New York containing ten acres of land more or less together with all & singular the appurtenances & hereditaments thereunto belonging. Also all that other piece or parcel of land situate in the said town of Hamden, County & State aforesaid, & bounded on the North by the highway leading from the Village of Hamden, to Hamden Hill on the South by Main Street of the Village of Hamden, on the South by my door yard fence, (being a stone wall,)& on the North by a stone wall, containing about three acres of land & includes the House and lot hereto leased by me to Catharine Crawford, & now occupied by her. I give & bequeath all of the above described premises to my said wife Louisa Crawford with all of the appurtenances rents issues & profits thereof for & during the term of her natural life & from & after the decease of my said wife, I give & bequeath the said above described lands & tenements unto my two daughters Jennett Crawford & Louisa Crawford and unto their (illegible) heirs & assigns forever.

I do hereby declare that I give & bequeath to my wife the use of the above described premises in addition to her right of dower in any other property which I may have at the time of my decease.
And lastly, I hereby appoint my said wife Louisa Crawford Executrix & Henry Davie of Delhi, Del County, N.Y. Executor
Of this my last will & testament hereby revoking all former wills by me made.

In witness whereof, I have hereunto set my hand & seal this 9th day of June 1866.

The above instrument consisting of one sheet was at the date thereof signed, sealed, published & declared by the said Donald Crawford, as & for his last will & testament in presence of us who at his request & in his presence & in the presence of each other have subscribed our names as witness thereto.

Delaware County Surrogate's Court.

In the matter of the Probate of the Last Will and Testament of Donald Crawford, late of said County, deceased,as a Will of Real and Personal Estate

Charles E. Hitt, of the town of Delhi in the County of Delaware, being sworn, deposes that he saw the above named Donald Crawford, late of the town of Hamden, in the County of Delaware, deceased, subscribe and execute the instrument now shown him and which purports to be the last Will and Testament of the said Donald Crawford, and bears date the 9th day of June 1866, and that he heard the said Donald Crawford declare the same to be his last Will and Testament, and that he, this deponent, together with Harvey F. Davidson, the other subscribing witness subscribed his name as a witness to said instrument at his request, and at the time thereof the said Donald Crawford, was of sound mind and memory, of full age to make said Will, and not under any restraint.

In the matter of the probate of the
Last Will and Testament of Donald Crawford, late of said County, deceased,
as a Will of Real and Personal Estate

Harvey F. Davidson, of the town of Delhi, and the County of Delaware, being sworn, deposed that he saw the above named Donald Crawford late of the town of Hamden, in the County of Delaware, deceased subscribe and execute the instrument now shown him and which purports to be the last Will and Testament of the said Donald Crawford and bears date the 9th date of June 1866, and that he heard the said Donald Crawford, declare the same to be his last Will and Testament, and that he, this deponent, together with Charles E. Hitt the other subscribing witness subscribed his name as a witness to said instrument at his request: and at the time thereof the said Donald Crawford was of sound mind and memory of full age to make said Will, and not under any restraint.

I Henry Davie of the town of Delhi Delaware County N.Y. one of the Executors named & appointed in & by the last Will & testament of Donald Crawford late of the town of Hamden, Del Co N.Y. deceased do hereby renounce the said appointment & all right & claim to letters testamentary of the said last Will & testament or to act as Executor thereof & pray the Surrogate of the County of Delaware to accept & record this my renunciation
