Record of the Last Will and Testament of Sarah A. Bush Be it remembered, that heretofore, to wit: On the 10th day of May in the year of our Lord eighteen hundred and ninety five, Robert Johnson, Attorney for the Executor named in the Last Will and Testament of Sarah A. Bush, late of the Town of Franklin, in the County of Delaware, deceased, appeared in open court, before the Surrogate of the County of Delawareand made application to have the Last Will and Testament which relates to both Real and Personal Estate, proved: and on such application the Surrogate did ascertain by adequate evidence who were the heirs at law and next of kin of the said testatrix and their respective residences, and said Surrogate did thereupon issue a Citation in due form of law directed to the heirs at law and next of kin by their respective names requiring them to appear before said Surrogate at his office in the Village of [Franklin] in said County on the 29th day of July, AD 1895 to attend probate of said Will.And afterwards, to wit: on the 14th day of December AD 1895 satisfactory evidence by affadavit was produced and presented to said Surrogate , of the due service of said Citation in the mode prescribed by law, and on that day the proponent appeared in support of the probate of said Will and no one appearing to oppose the probate of the same, such proceedings were thereupon had in said court that the said Surrogate took the proofs of said Will hereinafter set forth upon this 18th day of January AD, 1896 and he thereupon adjuged the said Will to be a valid Will of Real and Personal Estate and the proofs thereof to be sufficient, which said Last Will and Testament and proofs, are as follows, that is to say:In the name of God, Amen! I, Sarah A. Bush, of the Village of Franklin in the County of Delaware in the State of New York, do hereby make publick and declare this to be my Last Will and Testament, that is to say:First. I give, devise and bequeath all the property, both real and personal,of which I shall die seized and possessed to my Sister, Henrietta C. Bush, to be used and enjoyed by her during the ____ of her natural life, hereby authorizing and directing that the said property or my past thereof may be used and expanded for the needful and comfortable support and maintenance of my said Sister during her life. Second. I give, devise and bequeath all my property, real and personal, to Abram Bush and John Chambers, the Executors of this my Will hereinafter appointed, in trust, for the payment of my just debts and the discharge of the legacies and provisions of this Will herein- before and hereinafter recorded.Third. And from and immediately after the decease my said sister, I direct my said Executors to expend the sum of one hundred dollars in and towards the erection of grave stones or monument. Fourth. And at and immediately after the decease of my said sister, give and bequeath to my Nephew Clark Titus of Canfield, Colorado, one hundred dollars; and to Willett A. Titus, son of said Clark Titus, fifty dollars; and to Ella Amelia Titus, daughter of said Clark Titus fifty dollars; and to Lillian Chambers, daughter of John Chambers of Hamden, NY fifty dollars; and to Harold Lyon, son of Nathan L. Lyon, of Ellenville, NY fifty dollars; and to _____ Emily Freeman, daughter of Walter Freeman of ____,
Colorado fifty dollars; and to Helen Hymers, daughter of Stewart Hymers, of Delancy, New York fifty dollars; and to Abram Bush, of Franklin, NY one hundred dollars; and to Charles L. Bush, of Hamden, NY one hundred dollars.Fifth. All the residue of my property I give and bequeath to my Brothers, Abram Bush, Charles L. Bush, to be divided equally between them, share and share alike. And Lastly... I appoint my brother Abram Bush, and my friend John Chambers, of Hamden, NY to be the Executors of this my will: and I give to my said Executors, and to the _______ of them full power and authority to sell and convey any or all of the real estate of which I shall die seized, at public or private sale at such times and upon such terms, as to them shall seem proper, for the better fulfillment and performance of the trust hereinbefore confided to them.And I revoke all former wills by me made.
In testimony whereof, I, Sarah A. Bush, have to this my will subscribed my name and set my seal this twelth day of February, in the year one thousand eight hundred and ninety four.
On this twelth day of February, in the year eight hundred and ninety four, the undersigned, bring, present, believing the testatrix, Sarah A. Bush, to be of sound mind and memory, saw the testatrix subscribe the foregoing will.At the time of such subscription the testatrix stated to all the undersigned that the papers subscribed by her was her last will and testament.Thereupon each of us, in the presence of the testatrix, and at her request, and in the presence of each other, hereby attest and subscribe said will as witnesses the day and year first above written.Rob.
