Thanks to Linda Ogborn I have a copy of the original and will be happy to share it. I am hoping I may find someone with a connection to someone listed in the will. Betsey was living in Davenport at the time. (The punctuation and grammar is as it was in the original document.) --Melissa Duncan, November 6, 2000
THE LAST WILL and TESTAMENT
Betsey L. Wood of the Town of Davenport, County of Delaware and the State of New York
I, Betsey L. Wood, being of sound mind and memory, aware of the uncertainty of life and the certainty of death, and desirous of making an equitable and proper disposition of my property oat my decease. I do make, ordain, and publish and declare this to be my last WILL AND TESTAMENT in manner and form following, that is to say:
First, I give and bequeath to my daughter Elizabeth Smith my best bed and bedstead and my center table and armed Rocking Chair and also one half of all the remaining articles of household furniture and wearing apparel except as otherwise herein provided.
Second, I give and bequeath to my daughter Mary Artamesia Baker one half of all my household effects and clothing excepting and reserving all beds and bedding.
Third, I give and bequeath to my granddaughter Nellie Bishop the daughter of my son Zach T. Wood, one and one half of my bedding. The other half of my bedding to belong to my daughter Elizabeth Smith.
Fourth, To my grandson Jesse Wood the son of Andrew J. Wood fifty dollars.
Fifth, To my children Andrew J. Wood, Mary Artamesia Baker, Elizabeth Smith and Zach T. Wood all the remainder of my Real and Personal Estate, to be divided equally among and between the share and share alike.
Sixth, It is my request and I hereby authorize my executor to apply to the proper Court to have a suitable Trustee appointed to receive and take care of the share devised by me to my daughter Elizabeth Smith and to expend the same for her benefit or for the benefit of her children, as I have no confidence in her husband George Smith, and I want the money to benefit Elizabeth Smith and her children and not for the benefit of George Smith her husband.
Likewise, I make, constitute and appoint Elbert A Taber of Davenport Delaware County NY to be my executor of this my last Will and Testament, hereby revoking all former Wills by me made.
IN WITNESS WHEREOF, I have hereunto subscribed my name and affixed my seal, the 7th day of March in the year of our Lord, one thousand eight hundred and eighty-nine.
Betsey L. X Wood
The foregoing instrument was at the date thereof subscribed by Betsey L. Wood the testator therein named, in the presence of us and each of us. She at the time of making such subscription acknowledged that she executed the same, and declared the said instrument so subscribed by her to be her last Will and Testament. Whereupon we, at her request, and in her presence, and in the presence of each to her, do hereby subscribe our names as witnesses thereto.
