Samuel Campbell's Will

Be it remembered that at a Surrogates Court held in New York, County of Delaware on the Seventh day of April 1865 the last Will and Testament of Samuel Campbell late of the town of Harpersfield County of Delaware deceased was proved before the Hon. William Murray Jr. Surrogate and by him declared valid and established as a will of Real and Personal Estate and the same together with the proofs and examinations taken thereon is ordered recorded.

In the name of God Amen, I Samuel Campbell of the town of Harpersfield County of Delaware and State of New York being of sound mind and memory (Blessed to Almighty God for the same) do make publish and declare this to be my last Will and testament In manner and form following, that is to say:

First I give and bequeath to my (illegible) wife Margaret the South half of my farm the lot to be divided in the center lengthwise with the appurtenances there unto belonging to her own use and benefit forever, in lieu of dower excepting and reserving the South half of the dwelling for my daughter Phoeba Eleanor Bell.

Second I give and bequeath to my daughter Pheby Eleanor Bell, the ? half of my farm together with the south half of the house before mentioned the farm above mentioned is the lot on which I now live containing one hundred more of less.

Third I give and bequeath to my son John O. Campbell the farm as the Harper Lot containing 72 ½ acres more of less in addition to what I have previously given him and the said John O Campbell is to pay to James M Campbell fifty dollars out of his share in addition to what the said James M Campbell had received before and also to pay & discharge two mortgages to Harman Copley of three hundred dollars and the other five hundred dollars at his costs if the said mortgages are not paid at my decease.

Fourth I give and bequeath to Mary Jane Campbell one red and white spotted now three years old.

Fifth I give and bequeath to Robert Forrest McAuley Campbell the 1 year old colt.

Sixth I give and bequeath as follows to wit: to my wife Margaret Campbell four cows such as she may choose.
To Mrs. Phoeba Bell two cows.
To John O Campbell three cows.
To James M Campbell four cows

And lastly, I give to my wife Margaret my horses, harness, wagons, Sleighs, and my farming utensils and all the sheep and hogs and if there should be any on the place over and above what is now mentioned together with all the house hold furniture, beds and bedding except such as belongs to my wife Margaret and Mary Jane Campbell I will that it be equally divided between my three children Phoeba Bell, John O. Campbell and James M. Campbell and I also give to my son John O Campbell all my clothes and wearing apparel. I do hereby nominate and appoint James Bell of the town of Harpersfield County of Delaware to be the sole executor of this my last Will.

I witness whereof I have hereunto set my hand and seal and publish and decree this to be my last Will and testament in presence of the witnesses recorded below this eighth day of June in the year of our Lord one thousand eight hundred and sixty four.

last Will and testament of Samuel
Campbell late of said
County, deceased, as a Will of
Real and personal estate

Delaware County: John Harper of the town of Davenport in the county of Delaware, being sworn, deposes and says that he saw the above named Samuel Campbell deceased, late of the town of Harpersfield in the county of Delaware, deceased, subscribe and execute the instrument now shown him and which purports to be the last Will and Testament of the said Samuel Campbell and bears date the 8th day of June 1864 and that he heard the said Samuel Campbell declare the same to be his last Will and testament and that he this deponent together with James Harper the other subscribing witness subscribed his name as a witness to said instrument at his request, and at the time thereof the said Samuel Campbell was of sound mind and memory, of full age to make said Will and not under any restraint.

Delaware County: James Harper of the town of Harpersfield in the county of Delaware deceased subscribe and execute the instrument now shown him and which purports to be the last Will and testament of the Samuel Campbell late of the County of Delaware deceased, and bears date the eighth day of June 1864 and that he heard the said Samuel Campbell declare the same to be his last Will and testament and that he this deponent together with John Harper the other subscribing witness subscribed his name as a witness to said instrument at his request and at the time thereof the said Samuel Campbell was of sound mind and memory of full age to make said Will and not under any restraint.
