REPORT OF COMMISSIONER OF EXCISE

To the Board of Supervisors of Del. Co:

The undersigned, one of the Commissioners of the Board of Excise of the County of Delaware, in answer to a resolution of the 11th inst. "That the Commissioners of Excise be requested to report to this Board the number of prosecutions for violations of the Excise law, the settlement thereof, since the date of their last report, the amount of money received, of whom recieved and the disposition thereof" respectfully submit the following report:

First: That the whole number of prosecutions as embraced in the foregoing resolution are six, to wit: one against Daniel W. Sackrider, of the Town of Delhi, for violations of the 13th and 14th sections of the act of the Legislature of the State of New York, entitled "An Act to suppress intemperance and to regulate the sale of intoxicating liquors, passed April 16th, 1857" commenced on the 14th day of December, 1859 before C. H. Bell, Esq., a Justice of the Peace of said County of Delaware, and judgment obtained against him on the 25th day of February, 1860 for $100.00, being for two penalties, and for $2.96, costs of suit.

Another commenced in the Supreme Court of this State against Jonathan P. Flower, of the Town of Delhi, for violations of the 13th section of said act, also for selling strong and spirituous liquors on Sundays, contrary to sections 14 and 21 of the above mentioned act: that an adjourned Circuit of said Supreme Court, held in this County in the month of October last, said action was tried and a verdict obtained in faovr of the said Board of Commissioners of Excise, and judgment thereon entered up for the sum of $100.00 and cost being for Attorneys, witnesses fees & c. $84.36, on the 7th day of December, 1860.

Another commenced also to Supreme Court against Lemuel D. Mason, Town of Andes, for violation of the said 13th and 14th sections of said act: that on the 27th day of April, 1860, the said William Elder, confessed judgment for $100.00 and paid the costs and disbursements of the Plaintiff's Attorney, amounting to$14.25, and said Attorney gave the defendant a stipulation that the said judgment was not to be collected unless in case of a further violation of said Excise law.

Another commenced also in the Supreme Court against Elisha Wetmore of the Town of Stamford, for violations of said 13th and 14th sections; that on the 9th inst said action was settled on payment to the Commissioner's Attorney fees of $10.00 and agreeing to settle the Sheriff's fees for serving the summons and complaint amount to $1.94.

Another commenced in the Supreme Court against Manly M. Finch, of the Town of Davenport, for the violations of the said 13th and 14th sections; that on the second day of December inst. the said action was put at issue, and the same is now pending and undetermined.

Second: The number of suits settled since the date of the last report of said Commissioers, is two, as above mentioned to wit: those against Wm. Elder and Elisha Wetmore.

Third: The amount of money received and of whom received is as follows: $14.25 received April 27th, 1860, of Wm. Elder; $60.00 received of Elisha Wetmore on the 9th day of December, 1860, all as above stated.

Fourth: The money received by the Board of Commissioners since the last report thereof, has been disposed of in the manner following, to wit: The $14.25 received of William Elder, having been paid for the fees and disbursements of the Attorney of said Commissioners has been retained by him under the agreement made with him for the payment of such services and disbursements. The same disposition has been made of $10.00 received as Attorney's fees from Elisha Wetmore as above stated, is still in the hands of the Attorney of the Commissioners, no settlement having as yet been made by them with their said Attorney. In the opinion of the undersigned, such penalty should be applied in payment and discharge (so far as the same will go) of the disbursements and fees of the Commissioners' Attorney, made and incurred in other actions, for the satisfaction of which no means from such suits themselves is likely immediately to be obtained, as will hereafter more fully appear.

The foregoing statement, it is believed, contains a full answer to the inquires contained in the resolution of the Board of Supervisors. It may be, however, more satisfactory for the undersigned to state further, that an appeal was taken from the judgment obtained against Daniel W. Sackrider, by the defendant, to the county court of the County of Delaware, when the same was reversed, and judgment on such reversal was on the 20th day of November, 1860, entered against said Commissioners for the sum of $22.25 costs. The Commissioners have directed their Attorney to take an appeal from such judgment of the county court to the Supreme Court, if in the opinion of their Attorney he should deem the judgment of the county court to be erroneous.

At the date of the last report of said Commissioners, there were three suits pending . These suits have since all been tried, resulting in said Commissioners obtaining judgment against each defendant as follows, to wit: one against James Boyd, of Meredith for $50.00 and cost, $70.01. Said judgment was docketed Sept. 4, 1860 execution thereon has been issued against the property of the defendant and the same has been returned by the Sheriff of the county unsatisfied.

Another judgment has been obtained against John Swart, of Davenport, for $50.00 and costs, $73.52 and docketed on the 24th day of October, 1860. Execution thereon has been issued against the property of the defendant and is still in the hands of the Sheriff.

Another and a second judgment has been obtained against the said John Swart, for the sum of $50.00 and costs &79.67 and docketed on the 14th day of October, 1860 execution has been issued thereon against the property of the defendant and the same is now in the hands of the Sheriff.

The undersigned is informed by the Attorney of the Board of Commissioners, that said Swart and James Boyd are now reported to be destitute of property, although at the time of the commencement of the respective actions against them, each was represented to have an abundance of property to satisfy and judgment that might be obtained against them.

The disbursement made and incurred to these three last suits by the Attorney for the Commissioners, as the undersigned is informed by such Attorney amount to the sum of about $44.00. The Statute makes no provision for the advancement of the necessary expenses in the prosecution of actions, commencing by the Commissioners, nor for their payment in case of a failure of recovery or collection against the defendants. The Attorney for the Commissioners has thus far advanced the necessary moneys in actions commenced by them and the undersigned knows of no better way of reimbursing such Attorney were proper, then to apply so much of the monies collected form the penalties as shall be sufficient for the purpose.

In conclusion, the undersigned begs leave to further state, that in his opinion, founded upon a some what extended enquiry, the number of violations of the laws against unlicenced sales of intoxicating liquors is diminishing, only three actions, those against Mason, Wetmore and Finch above named have been commenced since the annual meeting of the Board of Excise in May last. It needs, in the judgment of the Commissioners, only the co-operation of the good citizens of the county with the Board of Commissioners, whether rallying under the names of temperance mentor the advocates of a license law, to confine the sale of spiritous liquors and wines, as the law intends, to persons licensed to make such sales, and thereby testing the efficiency of a license law, when property enforced, in restraining the many evils of intemperance. All of which is respectfully submitted.
